{"id":7904,"date":"2026-01-19T12:08:07","date_gmt":"2026-01-19T12:08:07","guid":{"rendered":"https:\/\/enforcementconductboard.org\/?p=7904"},"modified":"2026-01-19T12:09:07","modified_gmt":"2026-01-19T12:09:07","slug":"new-ecb-data-highlights-the-scale-of-the-enforcement-bailiff-industry-and-identifies-some-concerning-practices","status":"publish","type":"post","link":"https:\/\/enforcementconductboard.org\/cy\/new-ecb-data-highlights-the-scale-of-the-enforcement-bailiff-industry-and-identifies-some-concerning-practices\/","title":{"rendered":"New ECB data highlights\u00a0the scale of the enforcement (bailiff) industry and identifies\u00a0some\u00a0concerning\u00a0practices"},"content":{"rendered":"<p>Tuesday 20 January 2026<\/p>\n\n\n\n<p>The ECB has today published its first Insight Report, which sets out new data on enforcement (bailiff) industry practices using evidence from its complaints handling service and&nbsp;oversight work.&nbsp;<\/p>\n\n\n\n<p>The key findings&nbsp;on the industry include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The enforcement industry is handling\u00a0close\u00a0to\u00a08\u00a0million cases a year, impacting millions of people.<\/li>\n\n\n\n<li>The industry collects over\u00a0\u00a31\u00a0billion\u00a0a year,\u00a0the majority\u00a0of which\u00a0is money owed to public bodies from\u00a0unpaid parking and traffic fines and council tax\u00a0arrears.<\/li>\n\n\n\n<li>Goods\u00a0\u2013 primarily\u00a0vehicles &#8211;\u00a0were\u00a0taken away\u00a0by\u00a0Enforcement Agents (bailiffs) in over 2,600\u00a0cases in the\u00a0six month\u00a0reporting period.<\/li>\n<\/ul>\n\n\n\n<p><\/p>\n\n\n\n<p>Whilst the&nbsp;great&nbsp;majority of enforcement action complies with the ECB\u2019s&nbsp;Standards for fair enforcement, the report&nbsp;identifies some concerning behaviour&nbsp;including:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Mishandled\u00a0complaints<\/li>\n\n\n\n<li>Threatening behaviour<\/li>\n\n\n\n<li>Failing to support vulnerable\u00a0people<\/li>\n\n\n\n<li>Threatening to remove exempt\u00a0goods<\/li>\n\n\n\n<li>Clamping vehicles used by disabled people.<\/li>\n\n\n\n<li>Overcharging enforcement fees\u00a0on members of the public.\u00a0<\/li>\n<\/ul>\n\n\n\n<p><\/p>\n\n\n\n<p>In&nbsp;six months, there were 10 Enforcement Agents dismissed by their companies for misconduct \u2013 only two had their certificates revoked by the court. Most of the dismissed agents are&nbsp;therefore&nbsp;able to&nbsp;continue&nbsp;working.<\/p>\n\n\n\n<p>In its first&nbsp;nine&nbsp;months,&nbsp;the&nbsp;ECB\u2019s&nbsp;complaints service received over 500 complaints. Demand is growing&nbsp;rapidly&nbsp;and the ECB expects to handle several thousand&nbsp;complaints in 2026.&nbsp;The ECB has upheld half of the complaints that it has investigated.<\/p>\n\n\n\n<p>The&nbsp;report&nbsp;comes as Government&nbsp;faces&nbsp;growing calls from MPs and charities to tighten up the regulation of the industry. In June 2025&nbsp;the Ministry of Justice&nbsp;committed to legislate to give the ECB legal powers and&nbsp;published a consultationseeking views on&nbsp;how to do this.&nbsp;The Government is&nbsp;yet to commit to a timetable.&nbsp;<\/p>\n\n\n\n<p>Dywedodd Chris Nichols, Prif Swyddog Gweithredol y Bwrdd Ymddygiad Gorfodi:<\/p>\n\n\n\n<p>\u201cThe Enforcement Conduct Board (ECB) is here to ensure that everyone facing enforcement action is treated fairly.<\/p>\n\n\n\n<p>\u201cOur report reveals the enormous scale of enforcement activity across England and Wales and the significant role it plays in supporting public finances. Encouragingly, most enforcement firms and agents are following the rules that we set and carrying out their work responsibly.<\/p>\n\n\n\n<p>\u201cHowever, we have also uncovered some deeply concerning&nbsp;examples of&nbsp;firms and agents behaving aggressively, overstating powers,&nbsp;failing to consider&nbsp;health issues, and overcharging members of the public. These actions often&nbsp;impact&nbsp;vulnerable people in their own homes.<\/p>\n\n\n\n<p>\u201cThe ECB is determined to stamp out harmful enforcement practices.&nbsp;We arehandling&nbsp;a&nbsp;growing number of complaints and will&nbsp;soon&nbsp;introduce tougher standards to ensure vulnerable people are treated properly.<\/p>\n\n\n\n<p>\u201cGovernment must act too. Last year, it pledged to give the ECB new legal powers. Eight months have passed since its consultation, yet no legislation has been introduced.\u00a0Thousands of people are currently experiencing enforcement by companies who have refused to sign up to our standards and are subject to no independent oversight.
